That’s why an employer needs to be very careful while making the decision. After making the final decision, ask the criminal solicitors regarding the legal actions that you should take against the employee (if he is guilty).
For making the right decision, following tips can help you to do so:-
- You need to think on reasonable ground to check whether the employee is guilty or not. Otherwise the employee may take action like unfair dismissal against the employer.
- If require, being an employer take proper enquiry action to look into the matter in details. This is very much required to look for the actual culprit behind the action. If require, you should give opportunity to the employee to prove himself.
- As an employer, you can’t dismiss any employee on minimal level. Unless and until the action is considered to be offence on legal ground, dismissal won’t be justified. Similarly, if the employee has any legal background it doesn’t mean that he has to be the accused.
- If the accused is convicted of legal statement for about two and a half years, he has to accept it. After completion of the statement, the employer can not continue with his accusation against him.
- Later on while applying for the job in a new company, the employer may ask about the employee’s legal background. At that time, the employee should not be hesitant in mentioning the past.
- While making the decision, the employer should go through the amount of training of the employee.
